We hope that this site will assist the public in understanding the role of the Office of the Director of Public Prosecutions (DPP) and what our function is within the Criminal Justice system and the administration of Justice within the Cayman Islands.

Mission Statement

The Office of the DPP is committed to the prosecution of all criminal and traffic proceedings in a timely and efficient manner consistent with the interests of justice and to provide international legal assistance in all MLAT and Extradition matters. It is our mission to uphold our responsibilities as Ministers of Justice while seeking to serve the public interest and the criminal justice system with consistency, impartiality and integrity.

Office of the DPP

The position of Director of Public Prosecutions was created by Section 57 of the Cayman Islands Constitution 2010 and the Governor appointed the islands first DPP on the 1st of May 2011. The Director of Public Prosecutions is the Government’s principal legal adviser on Criminal proceedings and is responsible for all Criminal proceedings brought within the Cayman Islands. The Director of Public Prosecutions heads the office and is assisted by 3 Senior Crown Counsel and 10 Crown Counsel.

Role and Function of the DPP

The role of the Director of Public Prosecutions as outlined Section 57 of the Constitution is as follows:

  • To institute and undertake criminal proceedings against any person by any court in respect of any offence against any Law in force in the Cayman Islands.
  • To take over and continue any criminal proceedings that have been instituted or undertaken by himself or herself or any other person or authority.
  • To discontinue at any stage before judgment is delivered any such criminal proceedings instituted or undertaken by himself or herself or any other person or authority.

Additionally the DPP is responsible for all proceedings before the Traffic Court.

The Office of the Director of Public Prosecutions is primarily responsible for prosecutions in the Magistrate Court, Grand Court and Court of Appeal. The Prosecutors also have other responsibilities which include providing advice to the police and other Government departments on criminal proceedings.

The Office also receives and processes requests from Co-operating Territories in respect of Mutual Legal Assistance and Extradition Matters.
